I'm looking for an explanation and/or equivalent in Spanish for this. I have already posted an En>Es query, but would like a native speaker of English to explain what "fact of the agreement means in the following context:
You understand and agree that the terms and ***fact of this agreement**** shall be kept strictly confidential and promise that you, your spouse, representatives or agents shall not disclose, either directly or indirectly, any information concerning the terms of this agreement (or ****the fact of this agreement****).

The person signing the contract agrees not only to the terms of the agreement but also agrees not to disclose that the agreement even exists.
